State Fire Marshal Bans Open Burning in Henry County Due to Dangerous Conditions

A countywide ban on open burning has been issued effective March 13, 2025, at 4:00 PM, following concerns that current conditions pose a significant fire hazard. The Iowa State Fire Marshal’s Office enacted the ban after receiving a request from Walt Jackson, who represents Henry County Emergency Management.

Following an investigation, the Fire Marshal determined that the dry conditions in Henry County create a substantial risk to life and property, necessitating the prohibition of open burning.

The proclamation prohibits all open burning in the county until further notice, except in cases specifically permitted by Iowa Code 100.40(3). The ban will remain in effect until fire officials determine that conditions have improved and notify the State Fire Marshal accordingly.

Violating the proclamation is classified as a simple misdemeanor, per Iowa Code 100.40(2). However, certain activities such as supervised, permitted controlled burns, outdoor fireplaces, and properly managed barbecue grills remain allowed under the law.

Residents are urged to comply with the order to prevent potential wildfires and protect their communities. Authorities will continue to monitor conditions and provide updates as necessary.
